Digicel obtained an injunction from the Supreme Court of Jamaica on Friday afternoon ordering C&W/LIME to stop invading the privacy of Digicel customers, it was announced today.
Following an action launched by Digicel on 7th August 2009, the Judge found that there were serious issues to be tried regarding CW/LIME’s use of confidential customer information which, in Digicel’s view, has been surreptitiously obtained from the interconnection switches and exchanged as a result of the interconnect agreement between the two telecoms companies. The Judge ordered C&W/LIME to immediately cease and desist until such time as the case is determined through Arbitration.
Since June, C&W/LIME has been making tens of thousands of unsolicited calls to Digicel customers with various promotional offers in a desperate and underhanded attempt to get Digicel customers to switch to C&W/LIME to help it prop up its mobile business.
This behaviour was considered intrusive and bothersome by Digicel customers causing Digicel’s customer care centre to be flooded with calls from worried and upset customers who felt that their privacy was being invaded by a company with which they have no relationship.
Richard Fraser, Head of Legal and Regulatory Affairs for Digicel Jamaica, comments; “C&W/LIME’s business is in last chance saloon and it will quite literally try anything to claw back some customers. Our customers are our number one priority at Digicel – and our commitment to them is that we will do everything in our power to ensure that their interests are protected. We’re delighted with the Judge’s decision.”
